1. About Our Referral Services
Mya Cleaning Service (“the Agency”) operates as a Domestic Referral Agency under California Civil Code §1812.5095. We screen, register, and refer independent domestic workers to clients seeking cleaning services in the Los Angeles area. We are not a cleaning company. We do not employ the domestic workers we refer, and we do not direct, control, or supervise the manner in which they perform their work.
By using our referral services, you acknowledge and agree to the terms described below.
2. Important Notice — Relationship Between Client and Domestic Worker
Mya Cleaning Service is not the employer of the domestic worker referred to you. Depending on your arrangement with the domestic worker, you may have employer responsibilities, including employment taxes and workers’ compensation, under state and federal law. For additional information, contact your local Employment Development Department and the Internal Revenue Service.
This notice is provided in accordance with California Civil Code §1812.5095(f).
3. Scope of Our Referral Services
As a Domestic Referral Agency, our role is to:
- Screen and interview domestic workers and verify their work experience
- Verify domestic workers’ legal authorization to work in the United States
- Register qualified domestic workers with our agency
- Refer domestic workers to clients based on service requests
- Facilitate booking and payment processing as a limited payment agent (see Section 4)
- Follow up with clients to ensure satisfaction with our referral service
The Agency reserves the right to decline any referral request at its discretion.
4. Payment Processing and Referral Fees
4.1 Payment Processing Authorization
Mya Cleaning Service does not sell cleaning services. The domestic worker referred to you is the provider of the cleaning services. When the Agency collects payment from you, the Agency acts as a limited payment agent on behalf of the domestic worker, authorized to collect payment for the services the domestic worker has performed or will perform.
By using our referral services, you authorize the Agency to collect payment on your behalf and to process that payment in accordance with this section.
4.2 How Payment Works
The Agency collects the total service amount from the client. From that amount, the Agency retains its referral fee, which is based on a percentage of the job cost. The remaining funds are remitted to the domestic worker.
Important distinction: The Agency does not pay wages or payroll to domestic workers. The Agency remits client funds to the domestic worker, minus the Agency’s referral fee. Funds are remitted on a regular schedule for administrative efficiency.
4.3 Trust Account
In accordance with California Civil Code §1812.5095(b)(8), any payments made to the Agency are deposited into a trust account until remittance can be made to the domestic worker. The domestic worker is not obligated to pay the Agency’s referral fee, and the Agency is not obligated to remit funds to the domestic worker if the client fails or refuses to pay for the domestic services.
5. Service Information for Clients
When you request a referral through Mya Cleaning Service, we will communicate the following information so you know what to expect. These reflect the general standards and practices of the domestic workers registered with our agency:
5.1 Pets
Domestic workers referred through our agency will exercise reasonable care around your pets. However, the Agency does not assume liability for the health or safety of your pets. You are in the best position to ensure their safety and wellbeing during any cleaning appointment.
5.2 Property and Belongings
Domestic workers referred through our agency exercise reasonable care when performing cleaning services. Please be aware of the following:
- Carpet and rug snags: Carpet snags can result from exposed loops caused by normal wear and tear. Vacuum roller brushes may catch these areas. If you are aware of vulnerable areas in your carpeting or rugs, please let us know when booking so we can communicate this to the referred worker.
- Blinds: Blinds can become brittle from sun exposure and aging. Strings and cords weaken over time and may break during normal cleaning.
- Pictures, decorations, and mirrors: Items that are securely and properly attached to the wall should not fall when dusted or wiped. The Agency is not responsible for items that are improperly hung.
- Artwork, collectibles, or family heirlooms valued over $200: These items may be expensive or impossible to replace. It is the client’s responsibility to inform the Agency in writing of any such items at the time of booking. The Agency does not assume the risk of cleaning such items.
- Woodwork and specialty furniture: Please let us know during booking if you have unsealed woodwork, vintage or antique wood furniture, or items requiring special care products. If you would like to supply your own cleaning products for specific items (leather furniture, pianos, etc.), please notify us via email or text.
5.3 Utilities
Domestic workers need electricity and running water to perform cleaning services. If your utilities are turned off, we will reschedule your referral for when they are restored.
5.4 Access Limitations
For safety reasons, domestic workers registered with our agency generally limit their work to areas accessible with a standard 3-step ladder. This is sufficient for most first-floor windows, ceiling fans, and upper shelves. Similarly, domestic workers generally do not move heavy appliances or furniture, but can clean around and underneath them to the extent reachable.
5.5 Condition of the Home
If a home requires extensive work due to significant clutter or other conditions, the Agency will discuss expectations with you before confirming the referral. The level of results achievable in such conditions may differ from a standard home cleaning. By using our referral services, you agree to allow the Agency to photograph before-and-after conditions for internal quality review purposes only. Photos will not be shared or distributed without your permission.
5.6 Walls, Ceilings, and Other Exclusions
Domestic workers referred through our agency generally do not clean walls, ceilings, or animal waste due to the risk of property damage. Laundry services are generally only available if washing and drying machines are located inside the home. Services will not be provided while construction or other work is being performed at the home, as the home would likely require re-cleaning afterward.
6. Insurance
Mya Cleaning Service carries general liability insurance covering damage or breakage that occurs during a cleaning appointment facilitated through our referral service. We are not liable for damage caused by normal wear and tear, improper installation of items, or damage to artwork, collectibles, or family heirlooms valued over $200 that were not disclosed at the time of booking.
If any damage is noticed after the domestic worker has left, you must notify the Agency within 24 hours. We will work with you to come to a reasonable resolution.
7. Cancellation Policy
You may cancel a referral at any time. Cancellations made less than 24 hours before the scheduled service will result in a $50 cancellation fee.
Recurring service discount policy: If you signed up for recurring referral services and received a discount on your first appointment, but cancel your future appointments before the second scheduled appointment is completed, the discount you received on your first appointment will be charged back. If that cancellation is also made less than 24 hours before service, the $50 cancellation fee applies as well.
8. Satisfaction and Re-Clean Policy
We do not process refunds after services have been performed. However, if you are dissatisfied with the cleaning performed by a referred domestic worker, the Agency will arrange for a complimentary re-clean within 3 days of the original service date. Please contact us promptly with your concerns.
9. Reviews and Feedback
We welcome and encourage honest feedback about our referral services. However, the Agency has zero tolerance for any attempt to exchange reviews (positive or negative) for discounts, free services, or payments. The Agency reserves the right to decline future referrals to any client who engages in this type of behavior.
10. Non-Solicitation and Referral Buyout Fee
10.1 Non-Solicitation Agreement
The Agency invests significant time and resources in screening, interviewing, verifying references and backgrounds, and registering domestic workers. By using our referral services, you (the client) agree not to directly solicit, recruit, or hire any domestic worker who was introduced to you through the Agency for any home-related services outside of the Agency’s referral process.
This non-solicitation obligation applies for a period of twelve (12) months following the most recent referral of that domestic worker to you by the Agency.
10.2 Referral Buyout Fee
If you wish to engage a domestic worker outside of the Agency’s referral services, you may do so by paying a one-time Referral Buyout Fee of $5,000 per worker. This fee represents the Agency’s reasonable estimate of its losses from the direct hiring, including the costs of screening, registration, background verification, and the loss of future referral fees for that worker. This fee is a liquidated damages provision and not a penalty.
To arrange a direct engagement, please contact the Agency before hiring the worker. The Referral Buyout Fee must be paid in full before the direct engagement begins.
10.3 Domestic Worker Rights Are Not Affected
This section applies only to the client’s obligations to the Agency. Nothing in this section restricts the rights of domestic workers. In accordance with California Civil Code §1812.5095, domestic workers registered with the Agency are free to sign agreements with other referral agencies, perform domestic work for persons not referred by this Agency, and accept or reject any referral without penalty. This non-solicitation provision is a contractual obligation between the Agency and the client — it does not limit the domestic worker’s freedom to work.
11. Professional Attire
Domestic workers registered with the Agency are responsible for providing their own professional attire. The Agency makes branded apparel (such as shirts) available for voluntary purchase by registered domestic workers at a cost of $5.00 per item. The purchase of branded apparel is entirely optional and is not a condition of registration or referral. The Agency does not provide uniforms, and the availability of branded apparel for purchase does not create an employment relationship.
12. Indemnification
You agree to defend, indemnify, and hold harmless Mya Cleaning Service, its owners, officers, directors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including reasonable attorney’s fees) arising from: (i) your use of our referral services; (ii) your arrangement with any domestic worker referred by the Agency; (iii) any alleged or actual loss or damage to property arising from domestic services performed at your request; or (iv) your violation of these Terms of Service.
13. Limitation of Liability and Disclaimer of Warranties
Mya Cleaning Service provides referral services only. The Agency does not perform, warrant, endorse, guarantee, or assume responsibility for the cleaning services performed by the domestic workers it refers.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE REFERRAL SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. USE OF THE REFERRAL SERVICE IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYA CLEANING SERVICE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE DOMESTIC SERVICES PERFORMED BY A REFERRED WORKER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF USE OR PROPERTY DAMAGE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
14. Changes to These Terms
The Agency may revise these Terms of Service at any time. The most current version will supersede all previous versions. By continuing to use our referral services, you agree to be bound by the current version of these Terms.
